Hi Fellow forum users
I and my spouse both have primary/derivative through each other. However I only have EAD (dependent) through my spouse's principal AOS. Can I use that to change my job? I dont have time to apply for a principal EAD. Once I start the new job in dependent EAD can I apply for an EAD based on my primary AOS so that my new employer can drop a AC21 mail to USCIS? The reason I want to do this is to maintain my principal AOS as well.

If a H1B visa holder is in US, i know it is possible to transfer H1B to a different comapny in US. But can anyone help me understand if the same is possible if the person having the H1B visa is in india currently?

Using H1B visa, the person has worked in US for first 3 years. Now the person has applied for H1B extension and still the petition papers have not yet come. After applying extension the person has gone back to India. The person's current company is hesitating to send him back to US.
Question
After getting the petition papers, can one transfer H1B visa to a different company staying in india itself and them come to US via new comapany?

You will get RFE from USCIS if u have not taken all necessary veccinations.and u will have to take them then...

My company filed for H1B Extension as it is expiring in november 2009. How much time will it take to get the H1B extension approved ? Once i get H1B extension(probably for 1 year or 3 years), then should i go for H1B stamping, if so, i have to go to India for H1B Stamping. Let me know...

Hi,
I was working with a company in H1-b visa, and after 3 years renewed our H1 and H4 with the same company,
and both got extended upto 30th September 2011 . Later, i have transfered our H1 and H4 to a new company
in January 2009, and H1 extended from 10th January 2009 to 4th January 2012. After 3 months H4 approved
from 1st October 2011 to 4th January 2012.In short, H1 approved from the applied date of the last H1 to
4th January 2012, but H4 approved from the expiration date + 1 day of the previous H4 to 4th January 2012.
Since, i'm with a new employer what is the status of the H4 now. Looking for your valuable suggestions.

This might be little bit old, but I dont remember seeing a post on this. Employment-based immigrant visa fees almost doubled, Old fees $ 355, new fees $ 720 from July 13th. Does this mean USCIS will open the gates in Sept bulletin [to be released in August]?

I am working for a client which gave me an offer for a respectable amount. it is much higher than the amount specified in ETA 9089 (F/5) column. my Onet code for the original labor is 15-1071.00. my new job is defined as System Specialist. my job functions( roles) are pretty much the same as my original labor certificate. I tried to search the Onet Code for System specialist and did not find a good match.
Can any one suggest me what are the options.
I also wanted to know weather USCIS will send any letter to new employer regarding to the offer extended to me. MY situation is the client is not willing to sponsor me.

we are paying social security and medicare taxes where as we are not entitle to any of this benefits. they are taking this taxes based on giving permanent status but they have slowed green card processing near to impossible. that's fine, but taking social security taxes is not right when we are certainly not going to part of that system.
they must stop those taxes till green card is processed.

I used to fedex EAD and AP applications etc to this Augustine Road address before. After introducing lock boxes, they changes the fedex address too.I am planning to submit AC21. Do i need send to Lewisville address? Any experience in this regards is highly appreciated. Thanks for taking time to read.

Therefore, we recommend that EAD and AP renewals be filed 4 months prior to the expiration date, the earliest date USCIS will accept renewal applications. For EAD applications that have been pending for more than 90 days, an interim EAD card can be issued. Please contact our office for assistance with expedite procedures for your pending I-765 or I-131 application if your current work authorization is about to expire or if you have an emergent need to travel.

I have a question, actually I worked with a for-profit company A for few years and then transferred my H1B to a not-for-profit company B last year. Now can I transfer my H1B to a for-profit company C?
Actually one of my friend told, it is not possible and I can transfer only to the not-for-profit companies as I am currently working with a not-for-profit company B. Is this true?

depends on state law, WA state does not consider H4 as a resident, just found out a month ago, when my wife finished all the tests and everything else and found she had to pay non resident tuition. So she decided not to go to school. CA considers H4 as a resident provided all other criteria are met.

I am the principal beneficiary and my husband is my derivative, however he got his fp (On july 12) and I haven't received mine!
Should I go with him and try to get fp? I am afraid they wont let me do it, because I only have the case #'s from the back of the checks, i dont have receipts yet!
