I140 in process,
In my seventh year of H1b on a one year extension expiring in August.

Hi guys,

Please provide your valuable thoughts.

I have a Masters degree in the profession I'm working with 2 yrs of work exp prior to starting at this company. Altogether I have 5+ yrs of exp (prior + current).

My job requirements states "BA/BS or equivalent required with 5+ yrs of work exp".

I've read at some sites that if a candidate doesn't have a Masters degree, a Bachelor's + 5 yrs of exp will suffice, but the job description should require a Master's degree. In this case, I have a Master's degre with my job requirement saying "Bachelor's + 5yrs". Will I qualify for EB2? Please suggest.

Also what other options (tweaking requirements a bit) will you suggest?

A Masters degree or Bachelors + 5 years of progressive experience is the minimum requirement for EB2. In addition, your employer must justify in the future job description, that they require to hire a qualified person like you. Yes, it is the lawyer who decides on the employment category.

I first off apologize if there is already a thread pertaining to my questions. If so I would greatly appreciate being directed.
My situation is this...I came to the US as a visitor from Canada. As a result I did not need a I-94, a visa or a passport since i travelled by car. I am going to be married to a US citizen in a couple of weeks. I guess my questions are these...#1. Since I did not need any of those documents to enter the US, will this cause a problem while trying to prove status?
#2. I read somewhere about filing a I-30 prior to other documentation such as the I-485 and medical and so on. I was wondering if this is true or if i even need to file this document or if so if it can be filed in conjunction with the others.

Guys,

I filed our AP & EAD on August 10th with proof of 485 filing/delivery confirmation.
We got our receipt notices for AP 131 but unfortunately they have rejected our EAD 765 for incorretc filing fee of $180.
They written a notice saying the correct filing fee after July 30th is $340.

But for July VB is'nt the filing fee $180?

I have got back my entire documents packet for 765.

What should I do now? Should I resend the packet with a letter saying that I come under July VB? or should I send a new check for $340? Anybody gone thru similar experiences? Pls help.

On July 2, 2008, a US Federal District Court in California entered an order requiring that the USCIS pay Mr. Asghar Shirmohamadali, the plaintiff in a Writ of Mandamus (WOM) law suit against the USCIS, around $25,500 in attorney fees and $1,000 in other costs incurred during the suit. I am on H4 visa, based in Georgia. Did anyone get �Change of Maiden Name to Married Name� done on passport from Indian Consulate Houston, TX.
Can anyone tell me what am I supposed to write in the �Surname� column in the new online application form ? The old application had 2 columns, 1 for maiden name and the other for Desired Name, but the new online application form has only 1 Surname column. I am confused as to what should I write � my maiden name or my married name. I do have the notarization done on the affidavit form. Does this give me the right to write my married name ? Which name should I sign in the application- maiden or married name?
AlsoI have heard that anybody submitting �Change of Maiden Name to Married Name� application in person, to Indian Consulate Houston, has to collect the new passport at the counter in person, the passport will not be mailed to him/her. The passport is only sent by mail to those who have sent the documents to Indian Consulate Houston by mail.

My firm is about to start greencard processcing for me and this is the first time that they are undergoing this process. They are searching for letter templates which decribes the employee eligibility and responsibilies in the firm and why they want to recommend greencard for this perticular employee. Hi,

H1 Company is based in Phoenix with another office in delaware.I have gievn my address from NewHampshire on my LCA and NJ on my I 140 application.I work for a client in Newyork.I have given my address in New hampshire as I was not sure that my project will be for a longterm and gave my cousins address in New Hampshire for LCA.

I got an RFE asking why I have different addresses on my LCA and I140 while my company is based out of Arizona and Delaware.Please suggest how I should be answering this.
